Terms of Service

These terms are a binding agreement between you and Gisti. By creating an account or using the service, you agree to them.

1. Agreement to these terms

These Terms of Service (“Terms”) govern access to and use of the Gisti website and application at https://gisti.ai(the “Service”), operated by Gisti (“Gisti”, “we”, “us”). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy.

Gisti is a tool for businesses. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to it. If you do not agree to these Terms, do not use the Service.

2. The Service

Gisti ingests customer feedback from sources you choose — file uploads, app-store reviews, support tickets, team messaging channels, a feedback API, and meeting transcripts — and uses AI models to group that feedback into themes, generate opportunity summaries and impact scores, and answer questions through an assistant. We may improve, add, or remove features of the Service over time.

3. Accounts and workspaces

You must provide accurate registration information and keep your credentials confidential; you are responsible for activity under your account. Sign-up requires a work email address or a Google account. Accounts sharing a verified business email domain may be joined into the same workspace.

Workspace administrators control who can join their workspace and what role each member has (admin, editor, or viewer). Adding a member gives them access to the workspace’s feedback data in accordance with their role.

4. Plans, trials, and billing

The Service offers a free plan, subject to monthly usage quotas, and paid subscription plans as described on our pricing page. We may change prices or quotas prospectively; changes to a paid plan’s price take effect at your next renewal, with prior notice.

Paid plans may include a 14-day free trial. Unless you cancel before the trial ends, your subscription begins and the payment method you provided is charged. Subscriptions renew automatically each billing period (monthly or annual) until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and your workspace then returns to the free plan. Except where required by law, fees are non-refundable.

Payments are processed by our payment partner, Dodo Payments, under its own terms; Gisti does not store full payment-card details.

5. Your content

You retain all rights to the feedback data, files, and other material you or your integrations submit to the Service (“Customer Content”). You grant us a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide, secure, and support the Service — including sending it to the AI model providers described in our Privacy Policy. We do not use Customer Content to train AI models.

You are responsible for Customer Content: you must have the rights and lawful basis needed to collect it and submit it to the Service, including any notice or consent required from the people it describes. In particular, if you invite the Gisti notetaker to a meeting, you are responsible for complying with laws that govern recording conversations, including obtaining participant consent where required.

6. Integrations and third-party platforms

The Service can connect to third-party platforms — such as Google Play, the Apple App Store, Zendesk, Slack, Intercom, and meeting providers — at your direction. Your use of those platforms is governed by their own terms, and you are responsible for complying with them. We access connected platforms only as needed to provide the integration you configured, and you may disconnect an integration at any time. We are not responsible for third-party platforms, including changes to their APIs that affect an integration.

7. AI-generated output

Themes, summaries, impact scores, and assistant responses are generated by AI models from your Customer Content. AI output can be incomplete, inaccurate, or misleading, and may not reflect every piece of underlying feedback. The Service presents linked evidence so your team can verify output before relying on it; you are responsible for decisions made based on the Service. AI output is not professional advice.

8. Acceptable use

You agree not to:

  • use the Service to violate any law or the rights of others;
  • submit content you lack the right to process, or content that is malicious, infringing, or unlawful;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent its security or authentication measures, without our written permission;
  • circumvent plan quotas, rate limits, or feature gates;
  • access the Service to build a competing product, or scrape it by automated means outside the documented APIs;
  • resell, sublicense, or share access to the Service outside your organization;
  • interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate access that violates this section.

9. Intellectual property and feedback

The Service — including its software, design, and branding — is owned by Gisti and its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described here. If you send us suggestions or feedback about the Service, we may use them without restriction or obligation to you.

10. Suspension and termination

You may stop using the Service and delete your account at any time by contacting shubham@gisti.ai. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable advance notice).

Upon termination, your right to use the Service ends. On request within 30 days of termination, we will provide a reasonable opportunity to export your Customer Content, after which we delete it as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including sections 5, 9, and 11–13) survive.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI output will be accurate or complete.

12. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, even if advised of the possibility. To the fullest extent permitted by law, Gisti’s total liability arising out of or relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim arose or one hundred US dollars (USD 100). These limits do not apply to liability that cannot be limited by law.

13. Indemnification

You will defend and indemnify Gisti against third-party claims arising from your Customer Content, your use of the Service in violation of these Terms or the law, or your failure to obtain notices or consents required for content you submit (including meeting-recording consent), except to the extent the claim results from our own breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts located in India have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and each party consents to their jurisdiction. Before filing a claim, you agree to contact us at shubham@gisti.ai and attempt in good faith to resolve the dispute informally for 30 days.

15. Changes to these terms

We may update these Terms as the Service evolves. We will post the updated version on this page and revise the “Last updated” date above; for material changes we will give you additional notice, such as by email or an in-app message. Changes apply prospectively, and your continued use of the Service after they take effect constitutes acceptance.
